Resignation & Absocnded From Duties By Employee

Dear Members,

One senior manager of our company has resigned from his position and absconded from his duties without obtaining a relieving letter. He has also not handed over his responsibilities to his Head of Department and has retained company assets, including a laptop, mobile phone, SIM card, data card, and other company property records. Additionally, he is in possession of the company's confidential trade secrets, financial, and economic information, which we fear he may disclose to our competitors or any third party.

Kindly advise on the appropriate action to be taken against him and provide me with a draft of the notice to be issued to address this misconduct. I would be grateful if you could share the draft of the notice.

This is a really concerning problem regarding the items he has not handed over. You should send a legal notice through an advocate before filing a case in a court of law.

It is difficult to suggest without having the information like the copy of the appointment letter, any undertakings obtained from the individual (service agreement, non-disclosure agreement, undertaking for the laptop/mobile phone, etc.), and it is also not advisable to obtain a draft from the HR community as this is going to be a long-term process, and you have to face a lot of music if he has intentionally made or provoked by your competitor. I suggest you approach a lawyer with all the information and proceed legally. You have to prepare a legal notice mentioning information and consequences for which he is liable and send a copy to the new employer if you know the address.
