Regarding PF - Manufacturing Company [Thread 167777]

Dear Senior,
I am working in a manufacturing company. there are 150 worker and 50 worker are permanent it means they are entitle for PF and ESI but rest are only member of ESI and they are geting Payment only weekly basis but now management has deceided to make whole worker as a PF member but they are not agree to give any leave or sunday in the payment .My question is it is right or worng ? please suggest me.

earlier also management were following illegal policy .management was paying ESI
for the workers paid on weekly basis but not PF .so it was totally illegal.
now they want to pay PF for all but donot want to give sunday and leave as per the law,that is also illegal.

Dear Nishant,
No not at all acceptable and more of 100 % wrong practises , if you continue to do this practise the employer has to face lot of legal consequences.

I totally agree with Sajid. As per factories act its illegal. Not only they should get the weekly offs but the other national holidays too and 1 leave for every 20 days worked as paid leaves.
I feel you should talk to your boss as it can create issues for the company too in long term.

dear nishanth,
nowedays all these happen in the managements side to cut down the cost on salary or wages. but overall hr suppose to see how best they can protect the company interest & employee interest. in this case hr suppose to more work on documentation part. hope u know it. need to save company and need to protect employees job

In case of PF, is it true that an employee earning above 6500/-, and he does not want to deduct his PF, then as an employer are we authorised to stop his deduction.

I would like to know that if an employe joins with salary more than 6500/- and he request not to deduct PF can we do so.. Pls let me know about how to go If we want to exclude any employee from PF ?
