Is It Fair to Make All Workers PF Members Without Offering Sunday Pay or Leave?

Dear Senior,

I am working in a manufacturing company. There are 150 workers, and 50 workers are permanent, meaning they are entitled to PF and ESI. The rest are only members of ESI and are only paid on a weekly basis. Now, management has decided to make all workers PF members, but they are not agreeing to provide any leave or payment for Sundays.

My question is, is this right or wrong? Please suggest to me.

Dear Nishant,

Earlier, the management was following an illegal policy. They were paying ESI for the workers who were paid on a weekly basis but not PF, which was totally illegal. Now, they want to pay PF for all employees but do not want to provide Sundays off and leave as per the law, which is also illegal.

No, not at all acceptable and more than 100% wrong practices. If you continue to do this practice, the employer will have to face a lot of legal consequences.

I totally agree with Sajid. As per the Factories Act, it's illegal. Not only should they get the weekly offs, but also the other national holidays, and 1 leave for every 20 days worked as paid leave.

I feel you should talk to your boss, as it can create issues for the company in the long term.

Nowadays, all these happen in the management's side to cut down the cost on salary or wages. But overall, HR is supposed to see how best they can protect the company's interest and employee interest. In this case, HR is supposed to work more on the documentation part. Hope you know it. We need to save the company and protect employees' jobs.

In the case of PF, is it true that an employee earning above 6500/-, and he does not want to deduct his PF, then as an employer are we authorized to stop his deduction.

I would like to know if an employee joins with a salary of more than 6500/- and requests not to deduct PF, can we do so? Please let me know how to proceed if we want to exclude any employee from PF.

It is totally illegal as we have to give the workers one day off in a week or compensate them with twice the salary.
