How to Calculate Total Leave Entitlement for Sales Promotion Employees?

vidyadhar
Dear Friends,

Under The Sales Promotion Employees Act 1976, a Sales Promotion Employee shall be granted:
a) Earned Leave on full wages for not less than one-eleventh of the period spent on duty.
b) Medical Leave on half wages for not less than one eighteenth of the period spent on duty.

So, as per these rules, how many days will be his total leave entitlement for the year if the employee was on the roles for the whole of the previous financial year and he has not availed of any leave in the previous year?

Thanks and regards,

I work in a pharmaceutical company. I want to know under which act should I have my leave policy; i.e., under the Sales and Promotion Act, the Shop and Establishment Act, or the Factory Act? Also, may I have the same leave policy for the office staff, the factory workers, and the field staff? Should the leaves be given in the same year or the consecutive year based on the financial year already worked by a staff?

Thanks,
Neha

Hello,

The attached PDF file contains responsibilities cleverly assigned by management to circumvent various industry rules and acts. It is signed by the General Manager of Marketing at a pharmaceutical company.

Can anyone confirm whether the job responsibilities outlined in the document will fall under the Salesman Promotion Act or the Industrial Dispute Act? Based on the available rules and the nature of the work, particularly if the role is not at the supervisor level and does not involve any reporting persons, can we conclude that the individual is a workman? In the event of any disputes, can one approach the labor court for resolution?

Thank you.

Dear Sir/Madam,

I have worked in a pharmaceutical company for 6 years. Now I have resigned. Can anyone please tell me if I am entitled to encash my earned leave? My settlement is currently under process.

Regards,
Chanderpal
