Salary And Letters Withheld

Dear All,
Am not a HR person, but I need advice from you seniors in the Industry. I was working with an IT company for about 2 years. During this period I availed fo Maternity Leave of 12 weeks. After I resumed office in 3 months I had to leave my job as my Husband got relocated outside India. I gave the company 45 days notice and then after completing the handover, left the job.
However, they have not given me my salary for about 2 months and no letter (releiving / experience). They say that since I had take Maternity Leave they will not give me the same. Please let me know what I can do. Right now I am out of India and they have stopped responding to my emails.
Please advise...

The best thing to do is to contact a lawyer and send a notice to your previous company.

you have to hire some one who can send legal notice and file a case in court.
you are entitle to get the same as well as relieving letter.

Yes,
I agree with MR.Malikjs because employer must follow law of the land. No women workmen is disqualified or penalised for maternity benfits she is entitle for. You employer is following unfair labour practices and his action illegal.
They are exercising his power to victmise you presuming that you will not goto the court and file any complaint against him. But employee must exercise his right and all HR professional will appreciate your action to teach lesson such people.
Because its general tendancy of employee that he/she think that this complaint of court case shall not adversly affect her/his career because of filing complaint against employer. Let me assure you no employer will take this as offence if that employer is fare and just.
