Navigating PF Withdrawal: How to Handle Notice Period Pay Issues with a Previous Employer

Hi,

I have resigned from my previous employer and joined a new employer without informing the previous employer. Instead, I showed my previous employer to the new one due to my short service with the previous employer. I have transferred all my previous Provident Fund (PF) amount to the previous employer's PF account. Now, I have created a new PF account with my current employer. When I tried to close the previous PF account with the previous employer, they are asking for the notice period pay which I cannot afford to pay. I want to withdraw my PF amount. Can anyone please let me know if there is any other way?

Of course, there is a way, and you can deposit your withdrawal form directly to the PF office with a letter stating that your previous employer is not signing it. Basically, you should serve notice.

Hi,

Although I do not endorse the view of not serving notice or payment in lieu thereof, you may still be able to deposit the PF withdrawal form following what has been mentioned by Mr. JS Malik. You could also get the PF withdrawal forms signed by a gazetted officer and submit it to the PF Office where your organization deposited your PF.

Hi,

You need to go to the nearest post office (or even your banker) and get attested the "Employee has signed in my presence" part on page 3 of Form 19 and also on 10-C. Don't fill up the format for Form 3-A, 5, or 10 on the second page.

After attestation from the gazetted officer, you may directly submit it to the concerned EPFO with a covering letter requesting to redirect the form to the concerned employer for counter attestation and filling up of further details citing noncooperation by the employer as the reason. I am sure doing this, your job would be done if not in a month then two, but for sure.

But one sincere suggestion, as a responsible employee, the obligation was cast upon you to inform your employer at least one month in advance. Think if you were in his place.
