Confused About Employer's PF Contribution? Who to Talk to in Your Company?

Hi,

I have a query regarding a PF-related issue. Actually, I have been working in a public limited company for 11 months. My company has 2 sister concerns registered under different names. Initially, my offer letter was provided by company 1, and my PF amount was deducted from the first month. After 9 months, due to some reason, they changed my employment to company 2 and informed me that I would be given a new PF number.

My company has credited the 9 months of PF contributions to my account (780 per month, totaling 6830/-). However, according to the PF Act, the employer should also contribute to PF. Unfortunately, my company has not communicated anything about the employer's contribution.

Can anyone suggest who would be the right person in my company to discuss this issue with?

Hi,

I am giving the reply assuming that your company is an unexempted establishment under EPF Act, i.e., the funds are managed by the EPF Organization. The employer is bound to contribute their part of the contribution. You do not need to worry if your name has been shifted to another company. Simply ask your employer to fill out Form 13 so that your PF accumulations could be transferred to the new establishment.

Regarding the less credit of PF, you must ask your HR or Personnel Manager about the same.

Dear Hema,

First of all, fill up the Form 19 and 10C for the first company and claim the PF. Then, fill up the same form for the second company. Alternatively, you can transfer the PF to the second company by filling out Form 13. My personal suggestion is not to go for PF transfer.

Note: If the job tenure is less than 6 months, Provident Fund is eligible but not the Pension Fund. Therefore, you can claim it from the first company, but you can claim both funds from the second company.

Dear Hema,

I am suggesting that you first transfer (Form 13 R) your account from Company 1 to Company 2. I think it's not only your own issue; it's a total employee issue. So, all together, ask the management and also inform the PF department. There must be a contribution by the employer, so you will surely get a solution.

Dear Ms. Hema,

Please check your PF account number. If the financial year has been completed, kindly collect the annual slip. Also, ensure you have submitted Form 2; if so, keep a copy of that.

Before withdrawing, shift your account from the first company and then proceed with the withdrawal process. If they do not provide proper cooperation, kindly make an application to your employer with all the necessary details and send a copy to the EPF Commissioner in the concerned area.
