Understanding Leave Entitlements Under the Bombay Shops and Establishments Act: What Are Your Obligations?

I am working in a Pune-based IT company. We are registered under the Bombay Shops and Establishments Act. Do we have to provide any particular number of leaves under the categories of EL/PL, SL, CL? Please advise.

In the Bombay Shops and Establishments Act, there is a provision for 21 days of paid leave in a year. However, there is no provision mentioned for Sick Leave (SL) or Casual Leave (CL) in the act.

In our company, we have a five-day workweek (Saturday and Sunday off). If employees take leave from Friday to Wednesday, in this case, we count Saturday and Sunday as part of the total leave days, making it a total of five days' leave.

Is this the correct way to handle it? Are there any laws that support this practice? We would appreciate your valuable input and suggestions.

Regarding Leave Entitlements Under The Bombay Shops & Establishment Act

Section 35 of The Bombay Shops & Establishment Act addresses your concerns. The act stipulates that an employee is entitled to 5 days of leave for every 60 days of work if the employee works for more than 3 months. Additionally, 21 days of leave are granted for 240 days worked, with the provision for accumulating up to 42 days of leave.

It is important to note that only 26 Jan, 15 Aug, 2 Oct, and 1 May are considered statutory holidays under the act. Furthermore, the act does not include provisions for Sick Leave, Compassionate Leave, Jury Leave, and Casual Leaves.
