How Can I Handle a Withheld Salary and Forced Resignation During a Recession?

Hi, Dear all !
I came across this site while surfing.
I am in desperate need of HELP ,to find the solution for HR related problem presently I am facing.

I, stay in Delhi and I joined a Mumbai based company with a branch office in Delhi.
While serving for about 17 months at managerial level. Suddenly few months back my salary for the previous month was withheld without assigning any reason. I was forced to resign immediately.
Ultimately, keeping in view all pros and cons, I resigned in good faith that my earlier salary will be released. Full & final settlement after that in few days.
Even after submitting my resignation my salary has not released.
I contacted our HR manager and I was told you will receive it with full & final settlement after 45 days as per company rule.
Today ,even after passing more then 45 days I am continuously following with HR department but there is no satisfactory reply.
In nut shell my query is what should one do ,without job in the recession time, with three dependents and without salary for three months?
I hope likely, any one you will be able to guide or suggest the right step to be taken.

Since they told you to quit, you should not have given them a resignation letter. This would prove that you resigned. Were you required to serve notice? If so, they may adjust the amount owed, claiming you did not provide notice, and therefore, they withheld your salary.

Don't lose heart; continue to seek new job opportunities and persist in requesting your dues. Pursuing legal action through a labor law officer may not be very effective since you have already submitted your resignation letter.

I don't think the labor department will help you in this regard because you were in a managerial position. What was your salary and nature of duties? It is necessary to determine if the labor department can assist you; otherwise, you may need to pursue the matter in civil court. Please provide clarification.

What did you mention in your resignation letter? Have all clearance and handover formalities been completed by the company? Kindly clarify.

I have given one month's notice. After that, there are no formalities, clearances, or any other correspondence in any regard.

Ideally, all organizations take about 45 days to process the FNF. However, in cases where an employee has been asked to leave, and that too for no fault of the employee, the FNF should be completed in about 2 weeks. I would recommend you to write an email to the CEO of the company with a cc to the HR head and your department head and apprise them of the situation. Hoping they would be empathetic to your situation, they should act fast. Please don't try to burn bridges in this situation.

Thank you for your response. I have been struggling financially and have been without a job for the past 4 months. I am prepared for a long legal battle if needed.

Is it possible for me to approach the company through the Right to Information (RTI) route? If so, could you kindly guide me on the process?
