Can My Contractor End My Contract Without Reason? Seeking Advice on Termination Rights and Benefits

rakhihr
Hi All,

I have been on a fixed-term contract for the previous 4 years and 6 months (contracts renewed yearly without breaks between contracts). Recently, my contractor terminated the contract when it was still valid until the end of this year. The reason they gave me (verbally) was the obvious economic slowdown and the closure of the project by the Principal Employer. Having said that, my contractor has issued a termination letter without assigning any reason for the same and wants me to acknowledge the termination letter for the Full and Final settlement. In my contract, the contract termination clause is 15 days' notice in writing or salary in lieu of notice. Please let me know:

- If the contractor could terminate my services without assigning a reason in writing? Is this procedural? In case he is obligated but not willing to do so, what is the redundancy or termination benefit I could claim?
- Are they correct in asking me to acknowledge (in writing) the termination letter for them to initiate the Full and Final process?
- Would I qualify for gratuity as I have worked continuously for 4 years and 6 months without a break between contracts? (This is not a part of my contract though)

Please advise me on any other termination benefits I would be eligible for and that I should be aware of in this case. Hope to hear from you all.

Regards,
Rakhi

Dear,

As per Section 25F, you are entitled to one month's gross pay as notice pay and retrenchment compensation at 15 days' pay for every completed year of service.
