Struggling with PF Form Rejection: How Can We Resolve This and Hold the Company Accountable?

Hello,

One of my friends is facing a problem in withdrawing the PF money as his PF form got rejected twice without any reason from the PF Department in Mumbai. (His last company's HR is not supporting properly.)

1. Can anybody help me with the concerned email or telephone number where I can inquire about the PF form status?

2. Can we file a case against the company? They are not taking any responsibility for the deducted PF money, and we are not sure if they are depositing the PF money with the PF department.

Please revert ASAP.

Dear,

You can file a case in the District Consumer Forum and make the PF authorities as well as the company a party to it. I suggest you talk to them or write a complaint to RPFC and send a copy of the complaint to the Central Provident Fund Commissioner. State the complete story. I think your purpose will be solved by this. Filing a case should be the last option.

Hi,

Whenever a PF form is rejected, the PF department sends back the form along with a letter mentioning the reason for rejection. Please check this with your previous company and ensure it is rectified. Your problem will be solved without having to resort to taking legal action against the company and the PF department.

Like what our Malik sir said, you can file a case in CPA. Since PF has a regulatory and facilitator role, you can also contact the central PF commissioner.

Yes, I agree with Sh. Malik. You need to first find out the exact reason for rejection. He needs to check with his previous employer by writing to them and keep a copy of the letter and the courier slip. This can act as proof when you eventually file a complaint. Alternatively, also check with the EPF officials for the reason. I'm sure they will help him out. I am saying this because I too faced a similar problem recently, and it was from the EPF office that I got the entire details of my transfer, which even my current employer was not able to furnish.

He needs to gather all the above information to file a case, which should be the last resort.

We agree with HTDesai. The PF Department, when rejecting Form 19 or 10 C, provides suitable reasons for the rejection.

Reasons may include:

1. Mismatch of the data filled in Form 19/10C and the Form 2 submitted earlier by the company.
2. Contributions not matching with the period worked by the employee.
3. Corrections needed in the form.
4. Claim already withdrawn.
5. Many other technical reasons.

In the discussed situation, the reasons for rejection must be clear, and appropriate action can be taken.

Ask the HR of your previous company to surrender the receipt of the filing of the application in the EPFO and resubmit the application to the EPFO along with the appropriate representation. This receipt will help you inquire about the status of your Form 19/10C.

Without identifying the reasons, filing a case is not the correct approach. EPFO may be a party only if it is established that the sum has been deposited with EPFO under a suitable PF number. Therefore, if you intend to file a case where EPFO is a party, ensure that the facts are accurate and the reasons for involving EPFO are valid.

Hi,

Usually, the PF Department does not return any PF form without assigning any reason. The reason for rejection might be mentioned clearly while rejecting or returning the forms by the PF authorities. Kindly verify the reasons mentioned in the letter, and you may seek help from the PF authorities regarding the reason for rejection. They will definitely sort out this problem.

If someone leaves the organization and does not withdraw his PF amount for approximately 6 years, will he be eligible for interest on his PF amount for those 6 years? If yes, then what rate of interest will he receive?
