Appointment Letter - Benefit Of Organisation OR Employees

Dear All

My query is that whether Appointment Letter / Offer Letter is for the benefit of the organisation or for the employees as I still see few company do not issue any sort of joining letter to their employees because they feel that this can be dangerous for the organisation itself. As far as my view is concern I strongly feel that Appointment letter is for the beneficial of the organisation as it ensures proper discipline and vigilance within organisation.

I request to all my friends’ kindly share your opinion on this.

Appointment letters are expressed terms and conditions of employment and give legitimacy to the employment.

Working without an appointment letter means the organization has a malevolent intention not to recognize your services and your legal rights. This results in a loss of pay to employees on account of PF contributions, ESIC, gratuity, compensation for retrenchment, lay-off, termination notice, and other benefits.

Employees are taking a risk with their lives in case of the death of employees. For example, I remember one case where an employee working as casual labor, feeding scrap metal into a furnace, accidentally fell inside and melted along with the scrap. Subsequently, the employer (Personnel Officer) removed his name from attendance records and claimed that the employee was not engaged on that day. His wife searched for her husband for months before one co-worker who was working with her husband on the same day witnessed that he was indeed on the job on the day of the accident, revealing the truth. A case was filed, and it took years to achieve justice.

We should advise people not to take risks. An employee may be asked to travel for official work, and if they are involved in an accident, their family may be deprived of legal rights.
