What Are the Current Wage Limits for a "Workman" Under the Industrial Disputes Act?

Dear All,

As per the Industrial Disputes Act of 1947, "workman" means any person (including an apprentice) employed in any industry to perform manual, unskilled, skilled, technical, operational, clerical, or supervisory work. However, this definition excludes individuals who are primarily employed in a managerial or administrative capacity; or those who, while employed in a supervisory role, earn wages exceeding one thousand six hundred rupees per month or carry out functions primarily of a managerial nature.

Please provide information on the current or revised maximum wages for the workman.

Dear,

Now to ascertain whether an individual is a workman or not, salary is not the criteria. It is the nature of duties that decides whether an individual is a workman. The Supreme Court has given a judgment in which a pilot of Indian Airlines was granted the status of a workman despite drawing a salary in lakhs per month.

Thank you,
J. S. Malik
