I am Kamal Prasoon Sinha, an HR Generalist & Administration Professional with 12.6 years of core HR/IR experience. I am currently working as Manager (Unit Head), HR & Admin with an engineering/electronics manufacturing organization in Pune.
Now let's come to the point. In my response to the input given by Mr. JS Malik, I had requested any circular issued by the PF Dept. When I use the term PF Dept, I am referring to the central authority of PF Dept in New Delhi and not any Regional PF Commissioners whose jurisdiction is limited to that particular region/state and not the whole country.
I have reviewed the documents/circulars uploaded at CiteHR and found circulars issued by Regional PF Commissioners of a few states (2 or 3) on the bifurcation of minimum wages for PF contribution. However, I did not find any circular/notification/clarification issued by the PF head office in New Delhi or details of any such decision taken by the Central Board of Trustees of EPFO.
To the best of my knowledge, the PF head office has not issued any circular regarding PF calculation on minimum wages. I agree with Mr. Malik that there are judgments of high courts in two or three states and also of the Apex court in this regard. However, a notification from the central authority of PF Dept in New Delhi is also required.
The usual practice is that whenever a judgment from high courts/apex court is made, the affected ministry/dept/unit issues a separate notification regarding that judgment.
For instance, after the Apex Court judgment on PF contribution on Leave encashment, the PF head office promptly issued a clarification on the matter addressed to all Regional PF Commissioners. Yet, on the current matter (bifurcation of minimum wages for PF contribution), no such circular/notification/clarification has been issued.
I would appreciate your further input on the matter.
