Is Our Electronic Time Attendance System Compliant with the Shops and Establishment Act?

Dear All,

Please let me know whether the time attendance system, which is an electronically punching machine that keeps a track record of late coming, logging overtime, daily attendance, absenteeism, and leave record, is approved under the Shops and Establishment Act. Or does it supersede it? Our company is in the manufacturing industry, so please let me know if it is approved.

I have clarified earlier with a labor inspector and also a legal consultant on this issue. I am told we need to approach the labor authorities for permission to use T&A. In software companies, all T&A is automated. It has become the new practice now.

I am recently being harassed by a local lab officer on this issue. We are one of the IT companies, and we have a practice of keeping all our time and attendance records on the computer. The officer says that you cannot maintain records only on computers. Can I have the opinion of any consultant on the matter or a draft letter for obtaining permission to avoid manual records and registers? This matter is urgent. Please help.

Dear Friends,

We have been using the 'Attendance Card Punching System' for 15 years. No labor officer or Factory Inspector has raised any objections. However, along with this, some of the statutory registers should be observed for inspection purposes. If the statutory officers in your area may object, please obtain prior permission; it's no harm. In today's IT world, this is common practice.
