Seeking Guidance on ESIC Pension Claims for Employee's Family After Tragic Accident

Hi,

One of our employees who joined services on 1st July '08 but expired on 1st Jan '09 in an accident while returning from his native place after the leave. He was drawing a Gross salary of Rs. 5125/- (3650 basic + 1565 HRA). Kindly let us know the procedure for claiming pension under ESIC scheme in such a case and also the quantum of money entitled to him. His family comprises of a wife and three children aged 9, 8, 7. The death occurred 300 kms away from the place of work.

His wife will not get any benefit from ESIC because the accident occurred while he was not on duty. His family will get only funeral expenses through ESIC. However, his wife is entitled to a pension through PF. First of all, you should guide them to obtain at least five death certificates.

His wife and two children will be entitled to a pension. You need to collect the death case form from the PF office. His wife will also receive the insurance amount through EDLI.

The widow will receive Rs. 1541, and each child will receive Rs. 385 as a pension in this case.

A person who has died and his family have been receiving a pension for the past few years. However, suddenly, his family is not receiving the pension anymore. Please advise on how to restart the pension and where we should submit his death certificate to resume the pension payments.

Kindly specify the type of pension they are receiving. If it is from EPFO, the necessary certificates will be a life certificate and a non-remarriage certificate. If so, please contact the relevant bank or PF authorities.

If the person dies, who is covered under ESIC, then his nominee is eligible for how much % of the pension amount. Please guide.
