Stuck Without Support: How Can I Withdraw My PF Money When My Ex-Employer Won't Help?

Hi all, maybe this question is as before, but I still need all your help.

I had to resign from my previous company due to a situation created by the people in the company where I had to resign. I was on-site at that time. The employer wanted to send me to another location without proper papers, so I refused, and he immediately sent me to India with a short notice of just 3 days. I couldn't leave everything behind in 3 days as it obviously takes time to settle everything and come back. They also did not pay me my salary while I was on-site, and it was really difficult. I somehow managed to get another job there. So, as per my contract and conditions, I came to India and resigned on short notice, asking to settle my notice period dues from the salary withheld. However, I was not given any relieving letter or exit.

Now, I had been working with this company for 3 years, and I have a lot of money in my PF account. I don't know how to withdraw this amount because I know my ex-employer will not help me.

Please tell me how to do this and how to withdraw PF money in this situation.

Hi,

No employer is authorized to stop the withdrawal of PF amount in any situation. However, in some cases (fraud case, cheating case), the employer has the right to suspend the withdrawal of PF for a couple of months but not for a long time.

You can do one of two things: transfer your PF amount to your new account by using form no 13, or withdraw the amount by submitting form no 19 & 10 C.

For form no 19 & 10 C, you can obtain the form from the PF website, fill it out, and have it attested by your bank manager. They will verify that Mr. X's signature matches the bank statement. Then, send the paperwork to RPFC and mention if the employer is harassing you to sign the paper.

In that case, the PF commissioner will write to the employer and obtain the signature from the concerned authority. Since the PF amount falls under the Social Security Scheme of the Government of India, no authority can stop the withdrawal.

Hi,

I have a question. I was working in a company from Sep 1997 to Sep 2000 and in the next company from Nov 2000 to May 2001. I have just not done anything with my PF in both the companies. I am currently moving to a new company from April 2009.

My question is:

1. Can I withdraw the money?
2. Can I transfer my earlier PF accounts to my new PF account that will be created in my new company?
3. My second company is in Pune (previously that was in Mumbai when I was working for that company), so can I give the withdrawal forms in the Hyderabad PF office?

What will be the best option for me? If withdrawal is the only option, how do I go about it? I live in Hyderabad, and the second company is in Pune. There is no point in me going there to get my PF documents signed. The first one is in Hyderabad, so I can probably get the employer's signature.

Any suggestions will be welcome.

You can withdraw your PF amount by simply filling out the form and getting it signed by any Gazetted officer or Bank Manager from where your account is held. Then, you can deposit the form with the PF office.
