Workplace Accidents Without Insurance: What Are Employers Legally Required to Do?

Hello,

Suggestion required from you all, in case of an accident during official duty (fatal/non-fatal) if the workman is not covered under any insurance policy (ESI/WC/ etc.), what is the mandatory liability of the principal employer/principal contractor in case of monetary support or demand from the family of the deceased or injured.

In respect of an employment injury sustained by an employee not covered by ESI, or where he is not a worker as defined in section 2(n) or Schedule II attached to the Workmen's Compensation Act, 1923, the liability of payment of compensation rests with the employer only. The amount of compensation shall be calculated with reference to the severity of the injury and the loss caused to earning capacity due to the said injury. It is possible to calculate the compensation according to the provisions outlined in the Workmen's Compensation Act itself.
