Contractor vs Permanent Employee: Where Can I Find Guidelines to Stay Compliant?

wfortson
In the past, I have seen rules/guidelines used to determine whether a person is a contractor or a permanent employee. Can someone point me to a website that contains this information? My company is trying to set up some contract positions, and we want to ensure we are within the required guidelines.

Thanks,
William

Hello, William,

The information to determine whether the IRS would rule an employee to be classified as paid through a 1099 or offered employee status can be found in a variety of locations from a variety of sources. Feel free to Google "1099 vs Employee" and you'll find many hits. One of the more complete checklists is available through the Top Echelon Recruiters webpage at: http://topechelon.com [i]<link updated to site home></i>. Keep in mind that they have copyrighted the material on the webpage, and they have posted a fairly broad disclaimer on the site; they make it clear that reading of the site does not create a legal obligation on their part (as it doesn't on mine either) but it's quality material and will probably meet your needs.

Hope this is helpful.

Hi, good day to all. This is Sylvester P. Can anyone send me sample formats of different types of Offer/Appointment orders in Word format for different levels? We are now in a position to take all our contract employees onto our regular rolls.

Especially, I am looking for the formats to be used under the below-mentioned conditions:

1) When a trainee is observed into regular rolls after the completion of his training period.
2) When an employee gets a promotion and increment.
3) When an employee is transferred from one location to another.
4) When an employee's job is confirmed after his probation.

Please let me know if there are any websites to get these sample formats.
