Struggling to Access My PF and Final Payments After Leaving My Job – Need Urgent Help!

Dear Sir,

I was working in an organization (Biggest Amusement Park) in Mumbai from January '07 to 20th July '08 in the position of Assistant Manager. Due to a change in management and internal politics, all senior team members were compelled to leave the organization. Those who remained have begun harassing me to leave. I was forced to take this step due to these malicious individuals. I departed the company with a proper handover and clearance from all departments (a copy of which I still possess). However, after 8 months of separation, my Full and Final payments have not been cleared, and my filled PF form has been retained by them for an extended period. I was given a Resignation acceptance letter and a relieving letter by the former HR head. Despite my efforts through various communication channels (email, phone), they persist in delaying the process by citing trivial reasons such as pending client payments. I have the following queries:

a) How can I obtain my PF number? (It is not included in my salary slip, and they are unwilling to disclose it)
b) How can I withdraw the PF amount externally through EPFO?
c) How can I retrieve my Full and Final amount, although I suspect they will not release it?

I urgently require assistance as resources are crucial during this recession period, especially in accessing my PF funds.

Without knowing your PF number, it is very difficult to advise you on how to claim your PF. First of all, you need to obtain your PF number from the HR department, or check with the local PF authorities (Regional P.F. Commissioner's office), or file a complaint with the PF authority. Initially, check your payslip to confirm if your PF contributions are being deducted. If they are, then you should already have your PF number. After that, complete your PF forms and submit them to the PF office, ensuring they are duly signed by your previous organization or the bank where you have an account. If you are facing issues with your Full and Final (F&F) settlement, you can file a complaint against the employer with the relevant payment authorities.

Firstly, nobody holds your PF amount or claim.

Secondly, if the PF account number is not showing on your salary slip, you need to check if the PF deduction has been made or not. (However, the PF account number should be shown on the salary slip.)

Thirdly, if the employer is not ready to sign on your PF claim form or forward the same to the PF office, you need to fill out the Form 19 & 10C and attach a letter stating that your employer is not willing to sign. For this reason, you should send the form directly to the RPFO. The RPFO will then take necessary action against that particular organization to inquire about the reason, and based on that, they will provide an answer to the RPFO.

Regarding the Full and Final (F&F) settlement, if nobody attends to your complaint, you need to coordinate with a top person in the organization.

I left my first job around 6 years ago and unfortunately lost all my documents, including the one with the PF number. Subsequently, that company merged with a larger corporation and relocated to a different site.

Even though the PF amount is not substantial, it is disheartening to lose my hard-earned money. Please advise me on how to proceed to either have the PF amount released or transferred to my new PF account with my current company.

I left the job in October 2008, almost 1.1 years ago. I submitted my PF form in August 2009. I was informed that I would receive my claim probably in December 2009. However, there has been no response so far. Can anyone suggest what I should do now? Is there a possibility for me to get my claim by approaching the PF Office in Mumbai, where my PF account is based since they are headquartered there?

Dear Vinod M.,

You can write a letter to the Regional Provident Fund Commissioner of your area and inquire about the delay in your PF dues. I hope they will respond quickly. If not, you can utilize the Right to Information Act to obtain details about your payments.
