ESI Records Dilemma: How Many Years of Documents Should We Really Keep?

Hi,

If an ESI inspector asks to submit the records from the past 9 years, do we need to submit the past records? How many years of records need to be maintained with us? Please suggest urgently.

As per my knowledge, statutory compliance records should be kept for around 3 years.

Dear Sir,

As per legal requirements under the labor laws, there is no time bound and limit under the ESI and PF Act. Please note your record. In actuality, income tax and other acts have a 5 to 7 years limit in my opinion. Income tax and other acts should be checked and records submitted yearly to the relevant commissioner/director/superintendent. However, labor laws reports and other documents are not checked yearly by the related officer. Therefore, it is essential to maintain and submit 9 years of records to the ESI inspector.

I strongly advise you to have faith and submit records for the relevant years; otherwise, criminal proceedings may ensue.

Hi, as per ESI, you are required to maintain the records for 5 years. As far as ISO compliance is concerned, you have to maintain records for 3 years.

Dear Sir,

It is informed that as per the latest provisions of ESI & EPF, inspections are carried out by the field staff in cases where any default has been observed by the department or any complaint made by a person. If no inspection has been done since the establishment was set up, some records (only summary) should be presented to the ESI authorities. As these departments are social security organizations, there is no benefit in pursuing court matters as these organizations will utilize the social security benefits provided to employees.

As per ESI, now up to 40 employees, you have to submit self-certification, and no inspection will be done. However, you have to submit it on time and not become a defaulter.
