I would like to know who is a Motor Transport Worker and what is a Motor Transport Undertaking as per the Motor Transport Workers Act, 1961 with clear examples, please.
What I am looking for is not a reproduction of the definitions available in the bare Act, but some live examples.
For example, if a BPO company has its fleet of buses and transport staff like drivers, will the company then be called a Motor Transport Undertaking? Is the driver a Motor Transport Worker?
In another case, if a company uses its fleet of trucks for the transportation of scraps from one of its godowns to a dumping site, will the company then attract the provisions of the MTW Act? Will the cleaner boy attached to the truck be considered a motor transport worker?
If someone can elucidate the overlapping areas between the MTW Act, Factories Act, and Shops & Establishments Act and the problems faced by organizations due to such overlapping and ambiguity, it would be very interesting for enhancing our knowledge of what is happening in the country regarding these legislations when they compete with each other to cover the same organization.
