Ex-Company Ignoring Your PF Requests? Here's How to Legally Address It

ukumar
Hi friends,

My ex-company is not processing my PF account. I have sent many emails, but there is no response. What legal action can I take against them?

Dear Sir,

You just need to write a letter to RPFC in this regard and also send them the filled forms no. 19 and 10C without the employer's signature.

Hi,

Please download Form 19 & 10C from the EPFO website and fill in the details. Have the same attested by a notary public or gazetted officer. Submit the completed forms to your regional EPFO office. You will then receive your PF settlement. Note that employer signature is not mandatory in all cases.

Hi Vishnu,

You can fill out Form 19 & 10C. Instead of the employer's signature, you can obtain the signature of your bank manager.

Hi Kumar,

If you are unable to send the application through the employer or duly attested by him, for any reason whatsoever, you may forward the claims duly signed in the presence of any one of the following authorized officials and get attested over his official seal:

1. Magistrate
2. A Gazetted officer
3. President of the village union
4. President of the village panchayat where there is no union board
5. Chairman/Secretary/member of the municipal/district board
6. Post/sub-post master
7. Member of parliament/Legislative Assembly
8. Member of central board of trustees/Regional committee employee's PF
9. Manager of the bank in which the savings bank account is maintained
10. Head of any recognized educational institution
11. Any authorized official, as may be approved by the commissioner

I think it will be useful to you.

Warmest Regards,

Dear All,

Good morning!

What if I don't know the PF number, and the company is not providing it? How can we proceed in this case?

Cheers,
Guru.

Dear Kumar,

First, find out from the company if they have paid all the dues till date. If yes, then place your final request to the HR department. If you still do not receive a reply, then go to the PF office directly, raise a complaint with the PRO, and explain your status on the PF claim. He will definitely help you.
