Understanding Company Standing Orders: Are They the Same Across Different Locations?

Dear All,

I'm working in a corporate office of a manufacturing company. We have a Corporate office in New Delhi and two plants in Haryana and Rajasthan respectively.

Will the company's standing order be the same for all the places, or will it be different considering the local situations?

Please clarify.

The standing orders will have to be approved by the labor authorities of the respective state governments. This means that there cannot be any common standing orders for a company.

Hello,

The Industrial Employment (Standing Orders) Act, 1946, is a central legislation that is applicable to any industrial establishment employing more than 50 workmen.

However, in Maharashtra, the Bombay Shops & Commercial Establishments Act, which is a state legislation, was amended many years ago to attract the applicability of the Industrial Employment (Standing Orders) Act, 1946.

You have to, therefore, check if the Delhi Shops & Commercial Establishment Act has similar provisions as in the case of Maharashtra.

However, if an organization's manufacturing establishment is covered by the Industrial Employment (Standing Orders) Act, it does not automatically get extended to the organization's establishment anywhere if they are covered under the local Shops & Commercial Establishments Act unless these are also amended as in the case of Maharashtra.

Dear Malik Ji,

As you are based in Noida, you can help me with my case. I recently joined my current organization, which has its head office in Delhi and factories in Haryana and Rajasthan. The factories are covered under the respective state Standing Orders, but the Head Office is not yet registered due to some reasons. Now, there is confusion about whether the Head Office will be registered under the Delhi Shops & Establishment Act or the Factory Act of 1948.

Please clarify.
