Gratuity Confusion: Does Probation or Leave Affect Your Gratuity Calculation?

Kindly clarify the following regarding Gratuity:

1. Will the probation period be counted at the time of Gratuity calculation?
2. If an employee has sufficient Privilege Leave and takes leave for certain days, will it be considered a break in service when calculating Gratuity?

The probation period will be counted in the length of service, and leave may be with pay or without pay. There will not be a break in service.

Hi,

Can we add the unused and accumulated leave (PL) to the remaining period of employment for gratuity claim from a company? I am working in an MNC travel company for 4 years and 8 months and have unused PL, CL, etc., totaling 69 days accumulated over the years. Can I substitute these 69 days for the remaining days to complete 5 years so I can claim the Gratuity? If it is not possible to substitute the unused leaves, can I utilize these leaves after resigning, and will these days be considered to complete 5 years?

Are these 69 days encashable if I resign for better prospects at this point in time? Please advise as soon as possible.
