Day Off On 2nd October! Is It Mandatory Off Or Optional

Would like to check with you all that 2nd October is mandatory off for offices or it is optional.
Somebody was telling that All National holidays are mandatory off

Correct me if I'm wrong, but I think units which work round the clock, every day of the year, have special provisions for mandatory offs. You need to contact the legal authorities concerned for details of such provisions.

You have a very good query.
News channels can't afford National Holidays. Even Doordarshan does'nt.
More over essential services like mess, DG, Security etc. continue on National Holidays as well.
Has anyone any explanation to that, that whether it is legal or no.
Anyhow, we don't have any option is there a legal way or procedure for the same.

Hi guys,
All national holidays are compulsory offs and hence 2nd October should be a compulsory off too. In fact is there is a check by the authorities and the company is found to be in operation on those days, it could result in arrest of the directors / owners, etc. and / or fine.
In case a company has to work on these days, they have to seek permission from the concerned authorities. In my case since the company I work for is registered under Shops and Establishment Act, we would have to seek permission from the local office of S&A.
Your labour consultant can help you out with the letter format etc.

Hi all

Every State has a state Enactment called Industrial Establishment National and Festival Holiday Act for providing the grant of national and festival holidays to persons employed in industrial establishment. The state would specify in the Act the number of national and festival holidays to be allowed to the employees of any industrial establishments.

Usually 26th January, 15th August and 2nd October are common National Holidays for all states. Some states declare holiday on May 1st and some states not. The festival holidays would be declared by the employer and an approval for the statement showing the holidays allowed in each calendar year should be obtained from the local Labour Inspector where the industrial establishment is situated.

If any factory/establishment intending to work on the holidays declared or to change the specified holiday by the State, a prior approval or exemption order with respect to the same should be obtained from the Labour Inspector by filing an application.
