present my salary 10000 upto dec 08 now 1 st jan onwards 12000.
below 10000 esic applicable now my salry is 12000 esic applicable or not.

From the next contribution period which starts on 1st April 2009 onwards you will be out of coverage provided no notification to increase the present ceiling of Rs 10000 is issued by the ESIC. Till the end of the present contribution period (from 1-10-08 to 31-03-09) you have to contribute ESI.

i think both the freinds have already cleared your doubts but let me tell you that esic is not a liability but an asset and secondly your return will go till march ,but yes your deduction will stop .

Now since your salary is 12000 ESI is not applicable. But company will deduct ESI for this contribution period and after march it will not be deducted

could you give break-up of your salary to calculate qualifying amount for ESI.Some of the allownces are not taken into consideration while calculating qualifying amount for ESI.

As per the ESIC act Gross Salary 10000 and below its cover under ESIC But when your gross salary is 12000.00 than from yor salary no deduction of ESIC amount.

Hai, Good Morning ! Wish you and your family a very happy Sankranti. Yes still you need to pay ESI Contribution till March 09, i.e end of contribution period, as per Act. It is very clear in the ESI Act that a employee if he crosses ESI in the middle of the contribution, he has to pay ESI till end of the contribution. You are in the contribution period that is OCT-MAR 09. However, you need to pay contribution from April 09 onwards. Thanks, Prakash Parthasarathy

Yes ESI is applicable till the half yearly return period is over i.e. March' 09. After that is would not be applicable. Also please note that ESI will be calculated on 12000/- and not on 10000/-.
