Struggling with PF Withdrawals: How Can I Resolve This Issue from a Distance?

Hi Rafiq,

I kindly request your help. I left my previous company a year ago. I have applied for PF withdrawals twice, but I have not received any response from them. Upon checking with them, they informed me that they did not receive any forms. I am currently in Bangalore, and my previous company is based in Mumbai, where I worked in Hyderabad.

Could you please advise me on what steps I should take next as I am in need of the amount.

It may happen that the employer might not have paid contributions due and therefore, might not have submitted your withdrawal forms (Form 19 and 10 C). I advise that you send these forms by attesting your signature by the Manager of the Bank where you have an account or to which the amount is to be transferred. It is not mandatory that the employer himself should countersign withdrawal forms. It can be done by any other person such as a Bank Manager, Gazetted Officer, Member of the Central Board of Trustees of PF, etc. Regards, Madhu.T.K

I am not getting, sir. Where do I have to submit the forms attested by the bank manager? The bank manager means the branch where I have an account.

Bank Manager with whom you bank shall be preferred since it is a matter of attestation of signature. The forms are to be sent to the EPF Office (Asst. Provident Fund Commissioner, Sub/Regional Office of Employees' Provident Fund Organisation) where your PF accounts are maintained.

I would like to know on what occasions an employer can limit his contribution towards the employees to a basic of Rs. 6500. What are the provisions of the act?

Dear Friend,

I suggest that you fill out Form No. 13A and transfer your PF from your previous organization to your current one. Form No. 13A can be authorized by your current employer and then submitted to the PF office.

Dear Sekar,

12% PF is deducted at a maximum on a basic salary of 6,500 plus DA, which comes to 780. It is mandatory for the employer to deduct PF for all employees whose basic salary plus DA is up to 6,500. Above the 6,500 limit, PF can be deducted at the discretion of the employer; it is not mandatory for them. Once PF deductions have started by the employer, they cannot stop it, but the mandatory maximum limit is 6,500.

Dear All,

Could you please tell me if an employee joined a company with a salary of 14,000, but now their salary has increased to 20,000, and the employer does not want to submit their PF challan? Is this legal?

If when he joined the establishment at Rs 14000 per month, he was given PF coverage following company's policy or due to negligence or oversight or whatever, he will continue to be covered irrespective of any salary hike. The management cannot make him out of cover so long as he is in the establishment. The Act only says that an employee whose salary at the time of joining the establishment is more than Rs 6500 is exempted. It reads that if at the time of joining his salary was less than Rs 6500 and later on it rose more than Rs 6500, he will not be excluded from coverage. The PF Act also provides for the continuity of membership by which an employee once covered will be covered irrespective of any increase in his salary.

Thank you for your advice. The details of coverage up to 6500 are available on the website epfo. The clause mentioned does not specify the amount. Has the amount of 6500 been indicated in any gazette? Could you shed some light on this? Regards, Sekar 🙂:icon1:
