Is It Legal to Reduce Paid Leave to 15 Days Under the Bombay Shops Act? Seeking Advice

Hi,

As per the Bombay Shops and Establishment Act, there are 21 days of paid leave for which an employee has to work for not less than 240 days during a year (irrespective of his date of commencement). Provided that such leave may be accumulated up to a maximum period of 42 days.

Now, my question is, is it compulsory to provide a leave of 21 days for a year? I have drafted a leave policy stating:

A) 6 days Sick Leave
B) Casual Leave 6 days
C) Paid Leave 15 days

Can I reduce the paid leave to 15 days? I request you to let me know whether the policy drafted holds any sense.

The existing number of total leaves in our company is 27 days.

Dear,

According to the law, there are 21 paid leave days, so in your policy, you cannot reduce paid leave days. However, you can reduce days from other leaves that are not mandatory.
