Frustrated with Delayed Full and Final Settlement: What Should I Do Next?

Dear All,

I want your help on the above subject. I was following up with my previous employer for FNF, and they gave me different dates for releasing FNF. However, now they have informed me that they will not pay me my FNF. I had left the organization in the first week of September.

I would like to know what one should do in this case. Please reply with suggestions. I am waiting for your suggestions.

You have to file a complaint under Section 33C(2) of the Industrial Disputes Act with the Commissioner of Labour's office.

There is no recourse once the employer is not willing to pay your full and final dues.

Thank you for your reply. Could you please guide me on the address of the Labour office? I mean, where should I lodge the complaint? Alternatively, could you provide me with your number so I can call you?

Dear,

There may be an Assistant Labour Commissioner office in Thane itself. You can file a case under the Payment of Wages Act also with the same authorities.

Dude,

Did you ask them the genuine reason for why they are not clearing despite they promised to release? If possible, ask them to provide a written explanation for not clearing your dues, then seek legal actions.

Dear All,

I am facing the same problem too. Four months ago, I joined a consultancy. For the first two months, I received only a part of my salary, not the full amount. During this period, I placed a few candidates at my client's place and raised an invoice for approximately Rs. 2.00 Lakhs. However, the management is still saying that they can't pay my salary. Please suggest what I should do to receive my salary.

Firstly, you should follow the hierarchy and provide advice. Kindly complete my resignation formalities and issue a no-due slip. Otherwise, I will file a complaint. If there is no response, I will launch a complaint for the same.

Dear, if your claim includes PF, please lodge a complaint with the PF office. The web address is www.epfindia.com. Otherwise, register a complaint with the Directorate of Public Grievances Cabinet Secretariat online. They will forward it to all concerned.
