Unpaid for 3 Months: What Legal Steps Can We Take Against Salary Delays?

ravi.ydv2000@gmail.com
Dear [Recipient],

My company has not paid salaries to any of their employees for the last 3 months. They are stating that they are going through a financial crisis and assure us that all dues will be cleared soon. However, every day we are given new dates but no salary. I would like to know if there is any legal action we could take in this situation.

Thank you.

Dear,

As per the Payment of Wages Act, 1936 Section 15(3), it falls under the definition of delayed payment. You can approach the Labour Department, and as per the provisions of this section, the penalty is ten times.

Thank you,

Dear,

Actually, we don't have any appointment letter; we only received an offer letter. We were paid salaries for the first three months, and then the problems started. Could we take any legal action without having an appointment letter? We have attendance records with us.

Offer letter won't work here. It would be better for you to consult with a lawyer (a friend) and find out if you can go through the payslip details. I hope that you have received it.

Regards,
Take care

Dear,

We don't even have payslips with us, but a salary credited bank statement would do the needful.

Dear,

No problem, your attendance record will prove that you were in employment and present on these days. Earlier, your salary was paid by cheque. You have sufficient proof to establish your case.

What should we do now? Should we go to a labor court or civil court? And how long could it take to get the necessary action?

Dear,

You should approach the labor office because the assistant labor commissioner is authorized to handle these cases. Seek help from a legal professional and file a case. It will not take much time.

Thank you.
