Planning 2009 Holidays: How Many Days Off Should We Offer?

I am preparing a holiday list for 2009. Can anyone help me out with the maximum number of holidays to be given in a year?

Hi Smita,

The highest number is 14 holidays (Festival and national holidays). You cannot go beyond 14.

As per the law, you have to declare a minimum of 7 festival holidays, including three national holidays, which are a must.

THE TAMIL NADU INDUSTRIAL ESTABLISHMENTS (NATIONAL AND FESTIVAL HOLIDAYS) ACT, 1958

This Act provides for the grant of paid holidays for five festival and four national holidays, i.e., on 26th January, the 15th August, the 2nd October, and on 1st May each year, to every person employed in an Industrial Establishment in the State.

Please mention the industry you are working in, as it varies from business to business and industry to industry. In the IT industry, the maximum number of holidays should be 10.

Hi Smita,

I am sending a list of holidays available in 2009. According to your industry and your State/Region, you can decide on the holidays. However, the total number of holidays must comply with the limits set by your industry, as mentioned by others. National Holidays such as 26th Jan, 15th Aug, and 2nd Oct are mandatory, and 1st May is essential for Ind.

Hi Smita,

In my organization, we give 10 holidays. However, you need to consider all factors. We provide 10 holidays because we have a 5-day working week. In organizations that operate 6 days a week, 14 holidays can be given.

Hi,

I am Ramu Hegde from Bangalore, working at a private limited company in the garments industry. According to the Karnataka Industrial Establishment Act of 1963, the minimum number of holidays is 10 in a year, which includes 5 national holidays such as 26th January, 1st May, 15th August, 2nd October, and 1st November, along with 5 festival holidays decided by the company management.

Hi Smita,

Generally, the pattern is 3 national holidays and 5 others of general interest. If you are a manufacturing establishment (factory), you need to consult your union. Also, see the provisions of the Model Standing Orders applicable to you. If you are not a factory, then refer to the relevant act for your establishment, such as the Shops and Establishment Act, etc. You may also take cues from establishments similar to yours. In older establishments, the holiday pattern (number of holidays) is already set. Just follow them unless there is a very valid reason to deviate. In such cases, in my experience, it is difficult to lessen the number.

The determination of holidays will depend upon the nature of the business, rituals of the company, state laws, and the present market condition. Our company is in the FMCG manufacturing sector, and we observe only 7 out of 7 holidays, three of which are national holidays.

Hi Smit,

I'm in a cement manufacturing company, and we have 9 holidays coming up in the next year, similar to last year. There are 5 festival holidays and 4 national holidays, in accordance with the Factories Act.

There are two kinds of holidays:

1. Closed holidays, which are compulsory national holidays, consist of five festivals and four national holidays, i.e., on 26th January, 15th August, 2nd October, and 1st May each year, for every person employed in an Industrial Establishment.

2. Optional holidays: If an industry/organization is spread across different states, to accommodate the local importance of festivals, employees can choose 2 or more holidays, with the total restricted to the number of holidays decided by the company. There is a restriction regarding the minimum compulsory holidays, but there is no such restriction on the maximum number of holidays if the company is very liberal in this regard.
