As per the appointment letter, the Technician is in the staff category. Now, this person has joined the workers' Union. Can we terminate him as per the appointment letter's clause "Your appointment can be terminated by giving one month's notice from either side"? Please guide.
Union Membership and Staff Roles
Staff may not join the workers' union. There is a settled law of the Supreme Court. Workers' service conditions, wage scale, model standing order, and nature of work are different. Staff is supposed to supervise the workers and maintain discipline. But once he joins hands with the workers, who will do the administrative job? Therefore, he cannot join the workers' union.
