Muster Roll Compliance in India: Should It Be Handwritten or Computerized?

Dear All,

We have branches at a national level in India. Can anyone advise me on whether the Muster Roll should be handwritten or computerized for statutory compliance?

Please suggest.

When the number of employees increases, it would be a tedious job to have everything handwritten. Nowadays, various HR software is available that makes your job simpler.

Dear Mr. Kuldeep,

Please refer to Chapter III of the Information Technology Act, 2000. You may visit Laws - Information Technology Act - Section 4

Section 4 States:

4. Legal recognition of electronic records - Where any law provides that information or any other matter shall be in writing or in the typewritten or printed form, then, notwithstanding anything contained in such law, such requirement shall be deemed to have been satisfied if such information or matter is:
(a) rendered or made available in an electronic form;
(b) accessible so as to be usable for a subsequent reference.

So, we can maintain Electronic Muster Roll. Please maintain a necessary backup system for electronic data.

Dear Kuldeep,

Some states accept the computerized muster roll, but some of them are still asking for a manual attendance sheet.

As a contractor employer, what should I develop? Should it be 1) Attendance cum Muster Roll Register under Form 12 of the Factory Act or 2) Form 16 under the Contract Labour Act? Please suggest.
