Facing Pressure to Serve Notice Period at EXL Service: Can I Opt for Salary in Lieu Instead?

Hi, I'm an employee with EXL Service in Noida. Previously, we were based in the Gurgaon office, working for a very good process with Orange Telecom. However, when the process contract expired in October 2008, we were all redeployed to the Noida offices.

Now, I am looking to resign, but my managers are insisting that I serve a month's notice. However, according to the terms outlined in my "EMPLOYEE AGREEMENT" letter, it states that "After completion of the probationary period, either the company or you may terminate this agreement without cause by giving written notice of one month OR IN LIEU THEREOF, A SUM EQUAL TO THE AMOUNT OF SALARY WHICH WOULD HAVE ACCRUED TO YOU DURING THE PERIOD OR REMAINING PERIOD OF NOTICE."

I am seeking assistance as my managers, possibly due to business requirements, are pressuring me to fulfill the one-month notice period. Please support me. Thank you.

Hi Arjun,

The probationary period for an employee in an organization is to assess one's performance and suitability. If you perform well, you will be regularized. Determine whether you are currently under probation or have already been regularized. An employee can make their own decisions during the probationary period regarding whether to continue with the organization or not. This decision only impacts the regularization process.
