Facing a Legal Notice Two Years After Resignation: How Should I Respond?

I had resigned from the previous company 2 years back and received a relieving letter at that time without any difficulty. After a gap of 2 years, I have received a legal notice stating that I left the company without prior information to the company and took Rs. 10,000 from the company account. I have been asked to pay this amount without delay; otherwise, they will file a case. I have not even received the remaining dues from the company after my release. I am mentally disturbed. Please suggest what I should do.

Since you have the relieving order from the company, there seems to be nothing to worry about. Moreover, a legal notice for the recovery of a notice pay due 2 years earlier will not be valid. Do not respond to such notices. If the matter is taken to court, you can present the relieving order as evidence.

If you have the full and final settlement letter with you, then there is no need to worry. However, if the Company later finds any errors in the records on your part, the Company is entitled to recover any discrepancies. Upon receiving notice, you have the right to request details from the Company regarding the alleged amount owed to you. Once you understand how that amount is due to you, you will be in a better position to make a decision, and we will be in a better position to provide advice.

Regarding the recovery of outstanding amounts, there is a limitation period of 3 years from the date of the cause of action.
