Employer Not Paying Salary - Software Engineers

Hi All,

I am looking for some legal help from this forum. If possible please help me in blow matter.

I worked for a Bangalore based software company for 2.5 years as a software engineer. I have resigned from my job on march 2008,and i served notice period of 1 month.

While resigning they have promised me that they will pay final settlement amount , Relieving and service latter in next 15 days.

I got the service letter Clarence latter and relieving letter from the company but till now i didn't got any amount. I had escalate this matter to high label management but they are also not replying my emails and phone calls.

One day office manager form the company called me unofficially to scared and told me that company will take legal action against me because now I am working with one of the company's old partner.

After this I sent a legal notice through registered India post to the company regarding to pay my salary. But company intensely not receiving this notice and post returned came back to my address.

One of my friend told me that if I am going to file a case against employer than I have to attend the hearing of court when ever court is calling me.
Currently I am out side of India for next 2 years. So i don't how to proceed this matter.

Could you please suggest me the best way to get my salary form the company in this situation?

Dear Friend,
You can file a money recovery suit before the Civil Court where the office of your earlier company is located... It is not necessary for you to attend the matter for every occasion...At the time of evidence stage only your appearance will require.
Your appointed lawyer will take care for other steps like preparation of plaint, applications, receive the Written Statement of the Company etc.. Please note that there is restricted period for filing Civil Suit and it is 03 years from the last date of cause of action...the period will be counted from the date of your relieving or from the date of last reply received from the Company....
You have every legal right to demand your dues from your past company..Go ahead...

Hello friends
I am also going through the similar kind of stage as kings.11 mentioned.
I served 15 days notice to company instead on three month as mentioned in my appointment letter. company has sent two warning letters where they have clearly mentioned that acceptance of 15 days notice but forcing me to do handover (which was not a mandatory)
Few days back company has send last notice through a lawyer saying that as per appointment letter clause u have to pay 3 month basic otherwise they will file a civil case,
But the fact of the matter is company has not paid my 1 month full salary (including unserved notice 15 days + and served notice 15 days) also they not given my relieving & exprience letter till now.
Please help me its very serious thing and how can i fight against them ?

Please goahead through Civil Lawer who can fight your case ....
Definately you will get pending salary back & gainst all the court exp..
Advocates have lots of tricks to handle these type of cases..........
