Facing Termination Due to Hepatitis B: Legal and Supportive Steps for Hotel Employees

Dhanuindian
Hi seniors, I am working as a Senior Executive HR in the service and travel industry. There is an issue in one of my friend's companies (Hotel industry). One of his employees is working as a Chef and was found to have Hepatitis B during a medical exam. Due to this, his job is under threat despite working for the same company for 5 years. The management has been aware of his condition since he joined, but now they want to terminate his employment with some form of compensation. I would like to request clarification on the following points:

1) Is this legally acceptable?
2) If yes, please provide information on the compensation benefits if a person is terminated on medical grounds.
3) Are there any policies specifically addressing Hepatitis B in the Hotel industry?
4) How can we offer suggestions and support to him in this particular situation?

I believe this topic should be discussed in the forum, and we can utilize it as a case study since this is a new experience for me.

Employees can claim compensation under Workmen's Compensation for medical diseases arising from occupational hazards, injuries, and illnesses.

They can claim that their illness or diseases arise from working with employers for the past five years. This is one among the possibilities. Rather, as humanity dictates, employers should treat their employees ethically and morally. It is the duty of the employer to give the employee a chance to recover.

If the employer does not show a humanitarian approach, the employee can claim the expenses. By doing this, neither the employee nor the employer favors anybody.
