Managing Employee Termination Due to Background Check Failure: Insights and Practices

When an employee fails his/her background check on qualifications or work experience, his/her employment is terminated with immediate effect if the employee cannot prove otherwise. I have seen a couple of companies asking the employee to resign and providing the opportunity to seek employment elsewhere. The employee is issued a relieving letter, although he/she is not eligible for Full and Final Settlement related formalities. This is done on humanitarian grounds.

How is this process handled in other companies, particularly in the IT industry or your field? I am interested in gaining a better understanding of this. Your insights will be greatly appreciated.

If any employee fails in the referral report, he is likely to be terminated. This is because by giving false statements in the application for employment and joining reports, he has cheated the employer. This can be interpreted as misrepresentation of material facts, which is punishable following the Criminal Procedure Code as well. In government departments, the same will be viewed very seriously. If any employer has not taken the matter so seriously, it is due to their lenient attitude only.

If I am asked to assess such a situation, I must say that I will immediately dismiss him, and I will not ask for his resignation. By giving false statements about qualification and experience, he has not only cheated the company but has also confiscated the opportunity of the right candidate. That is not a tolerable offense.

Madhu, I came across an organization which is one of the top 2 IT companies in India. The HR manager fired 12 employees within 3 years just because of a failure in the background check. But, later the management found out that he himself lied by showing a non-existing organization on his resume. What do you think about this? To be honest, little thieves are hanged but the great ones escape. These background checks seem like just a formality. I suggest that every company should implement a new policy where the people conducting background checks must undergo a thorough check themselves before they begin working. Jai Hind. 🇮🇳
