Is ESIC Coverage Available for Medical Reps Across India Without Branches?

Is ESIC applicable to the Medical Representatives? If yes, then where can they avail medical facilities? It is crucial to note that the company has no branches, and all employees are covered under the head office, while these medical representatives are situated in various locations across India.

Please refer to the explanation for workmen under the ESI Act. According to this, those who are drawing Rs. 6,500 or less are considered workmen. Therefore, Medical representatives are to be covered under ESI. You can also refer to the case laws on this.

Regarding the dispensary, they can be registered under any dispensary in their locality. You have to issue the respective form (I am sorry, I can't remember) to your employees at their convenient dispensary.

The ESI limit is Gross Wages of Rs. 7500/- per month. I think that within a state, you will get ESI benefits, but it becomes difficult to access help from any state other than the state in which ESI is registered. Although legally it is applicable, practically the arrangement you are talking about in your office will make it difficult to get help. There are a lot of administrative red tapes that will prevent you from receiving proper help.

I am really sorry. The salary limit is Rs. 7500 for ESI and Rs. 6500 for EPF. For your information, we did not face any difficulty with ESI officials. It all depends on the rapport we built.

Of course, ESI is applicable to all employees whose salary is not more than 7500. For your M.R., you can provide Form-105 for outstation employees, and they can avail of the medical benefit by showing Form-105 across India. If your M.R. is continuously out of the station for a particular location, you can apply for the ESI sub-code based on your employees' local address. You can provide the employees' local address as your local communication address, and easily allot the ESI sub-code to provide ESI cards for your M.R. Also, follow the procedure of the outsourcing company on how they are obtaining the ESI sub-code without any office or business premises.
