I need some help. I joined a company back in 2004, and then 4 months later, I left due to some family problems. I informed my employer that I could not continue. He then mentioned that if I were to leave, I would have to send my passport for visa cancellation; otherwise, he would have to report me missing, which could result in a ban from Dubai for 2 years. Is that true? And what happens after the 2 years? Can I re-apply for another job without any problems or worries about a lifetime ban or anything else?

If he has completed 2 years of service and an NOC from the current employer is not available, or if he has less than one year of service but no NOC is available.

I have seen on the Ministry of Labor (MOL) website that there is a fee called the one-year ban lifting fee available. Is this applicable to employees without an NOC?

I have a friend who is getting me the details about my previous visa, that is if I have a ban or not. Do you have a Dubai contact number I could call you on if you can help me?

By the way, I went to Dubai in 2004 and left in the last month of that year. My visa was valid until I think October 2007. I just wanted to know, based on my situation, what ban will be applied to me and when does that ban exactly take effect: as soon as the visa gets over in 2007, as soon as I leave the country, or as soon as the employer informs me as missing.

The ban and threats from sponsors mostly depend upon your labor contract signed initially for processing your labor card. Hi, I too work in the UAE. I think you must have sent your passport to your employer (if you trust) so that the visa can be cancelled. Your employer was correct, and he made you aware that he might file absconding. In that case, you cannot come to Dubai in any case. I don't know how Jatin missed this. As a professional, if you are out of Dubai for more than 6 months, your visa will be invalid. I think it is too late now, and your employer must have filed absconding. Better contact your company and check the status; they will clarify this to my knowledge. Sometimes we do this - we will get the passport and cancel the visa when the passport holder is in India.

Nice to hear from you, but to ask you one question... How can you report an employee absconding if he's outside the country? This means you have authorized him to leave, and that person has not come back. My dear, absconding means "the employee is working with another sponsor under your visa, without your knowledge," which is illegal according to labor law.

Well, you are correct that the residence visa will be invalid if a person resides outside the U.A.E for more than six months. But in that case, the sponsor can only cancel their visa and not report absconding.

According to our company policy, we are required to file absences for workers who have been granted leave for one month but are not reporting to work. We will wait for 10-15 days before filing the absence, regardless of whether the person is in India or any other country, as we are under immigration control. Your first question was about termination during the probation period. Termination during the probation period is not as formal as after confirmation. The reason provided can be unsatisfactory performance.

The ban point can only be defined after knowing the current visa status, whether it is valid or the cancellation receipt of the labor card and residence visa.

Finally, I have found a group that would be able to help me with my UAE visa concerns.

I left the UAE in July 2008 for a vacation. After a month, I submitted my resignation letter to my employer. However, he didn't accept it and asked me to think about it, granting me a 6-month extension.

In January 2009, I informed him that I would not be returning and that my resignation still stands.

I have since joined a company in the Philippines. In February 2009, I had to visit Dubai for a business trip. My company applied for a visit visa, but it was denied because my residence visa was still active.

I used to work for one of the esteemed construction firms in Dubai from June 2007. However, due to some personal reasons, I came back to India on emergency leave in November 2007 and returned to Dubai in January 2008. Later, in July 2008, I came for my annual vacation, but due to personal problems, I could not return to Dubai, and even my visa was not cancelled.

I am Deepu. I was working in Dubai three years ago in security services. I worked there for 1 year and 2 months. My father died, and I went to India. I couldn't rejoin due to family problems. Hi Jatin, I had got a job in Sharjah, UAE, where I worked for 20 days on my visit visa. However, I had to exit the UAE as my visa was about to expire. The company where I worked said they would provide me with a Residence Visa. After returning to India, I received a good offer from Saudi Arabia. I informed my Sharjah employer about this, and he mentioned that my visa is ready but is demanding 10,000 DHS from me; otherwise, he will put up a Passport and Immigration GCC Ban.
