Maternity leave without confirmation after probation?

Hi,
Iam working in a US based consultancy firm,as an employee relation associate from feb 15th 2006, iam planning to take my maternity leave from oct;1st onwards, i do have a doubt here as our probationary peroid is 3 months and now iam on the way to 6th month, i haven't got my confirmation, i took some leaves in the middle due to illness with the permission , iam i eligible for maternity benefit of 12 weeks, during the regular pay? in all the 3 months i will be getting an incentives also, if i will get the maternity benefit then will i be eligible for the quarterly incentives?please advice me...

HI.
Though you are not confirmed, u will not get 12 weeks marternity leave. as well as in this period as u said u will not get any incentives also.
As per the rule a women employee can take 12 weeks maternity leave, and in this period she will get only basic pay subject to her confirmation.

Hi Cini,
PLs check you r appointment letter, most of US based firms write that you will be automatically confirmed after completeion of 3 months and no addition letter is required.
If that clause if not there in yur appointment letter then you have to confirm it clearly from the HR.
In case you are confimred then you are entitled to the maternity leave as well as your incentives.
