Am I Eligible for Maternity Benefits and Incentives Without Confirmation Post-Probation?

I am working in a US-based consultancy firm as an Employee Relations Associate since February 15, 2006. I am planning to take my maternity leave from October 1st onwards. I have a doubt regarding my probationary period, which is typically 3 months, and as I am now in my 6th month without receiving confirmation. I took some leaves in between due to illness with permission. Am I eligible for maternity benefits of 12 weeks with regular pay? During all 3 months, I will be receiving incentives as well. If I am eligible for maternity benefits, would I still be eligible for the quarterly incentives? Please advise me.

Hi,

Though you are not confirmed, you will not get 12 weeks maternity leave, as well as in this period, as you said, you will not get any incentives also.

As per the rule, a female employee can take 12 weeks of maternity leave, and during this period, she will receive only basic pay, subject to her confirmation.

Hi Cini,

Please check your appointment letter. Most US-based firms state that you will be automatically confirmed after the completion of 3 months, and no additional letter is required. If that clause is not present in your appointment letter, then you have to confirm it clearly with HR.

If you are confirmed, you are entitled to maternity leave as well as your incentives.
