Creche Requirement Under Factory Act 1948: Is It Needed for 30-50 Female Employees?

Please clarify whether the creche is required if the strength of females is more than 30 but less than 50.

There is no amendment in the Factories Act, and the requirement of creche is still applicable when there are 30 or more women employees.

According to the Factory Act 1948, Section 48, creches must be provided if women employees take their babies to the worksite. If a single woman brings her baby to the factory or worksite, creches must be provided. However, if no one is bringing a baby to the site, creches are not applicable. In the Factory Act, Section 33 prohibits the entry of child laborers to the site or dangerous operations. Providing creches is at your discretion.

Dear Vijay, The current rule states that if there are 50 or more female employees working in the organization, then a creche facility is applicable.
