Can My First IT Company Really Blacklist Me from All Future IT Jobs?

Hi,

I have been undergoing training in my first IT company since 25th July. Recently, they have implicated me in a cheating case in the Java module, although I am innocent, they are not willing to accept it. They have threatened me to either confess that I have copied, which will result in my graceful termination, or they will send my name to all IT companies for blacklisting.

They took my statement in a plain letter in which I wrote that I haven't copied from anyone. After I gave my statement to them, they said that now I will be terminated, and they will ensure that I will not get a job in any IT companies. I am very tensed as this is my first IT company.

Do they have the power to blacklist me from all IT companies?

Have you been terminated as yet? I suggest you collect all possible hard evidence towards this harassment to use later. I feel you should issue a counter threat if this is still continuing. For this you will have to consult a labor lawyer.

Very true... if you have not done as the allegation imposed. I would suggest that you keep everything in black and white. Write a detailed email to the superior in your division (VP/MD) mentioning the same. Mark a copy of the same to yourself for further reference.

Apart from this, try to solve the issue in your favor. The company cannot actually blacklist you with other organizations; however, the power of 'word of mouth' cannot be ruled out. The industry is too small, and people might know each other. It will be difficult for you to keep justifying every time.

Be cool and make a decision, and be confident that this is not the end of the world!!!

Take the opportunity to clear your name out of this controversy by putting an emotional email requesting clarification and clearance of your name from this controversy. If you choose to ignore this now, it will fester, and you will never know when in the future this may come back to bite you.

Please guide a person in the right direction rather than resorting to abuses towards the management/company, as it will affect his career. Try to ascertain the truth in what he is saying. Please judge correctly whether the management is wrong or the person is wrong. Also, consider if this person is guilty and the extent of damage he has caused to the company. All of this should be calculated.

I agree with Vibhuti Nagaich; it's the same approach that should be followed. Escalate the issue to the top management and then resolve it. It's a very small world, so ensure that you leave the company without any negative tags.

Don't bother. In case you can lodge your complaint to ASSOCHAM & CII. Your current employer can't blacklist you unless you have done something illegal. The company can't force you to conform to their self-created track just to build mental pressure. Kindly have all the legal aspects ready, as you have mentioned in the post.

Since you have provided a written statement, the company needs to follow legal procedures to take action against you. They can't blacklist you in any company across the globe. In my opinion, if any company victimizes employees through character assassination or false allegations without establishing the facts on record or providing them with a reasonable opportunity to defend themselves, all these actions fall under unfair labor practices. If an employer spreads false rumors in the job market to sabotage an employee's career prospects, the employee can take legal action against the employer to seek damages for the period of unemployment caused by the employer's misconduct.

In this situation, you should talk politely and clearly. For this, you should analyze the situation from the day of beginning. Write all happenings in sequence. Think and think and write it down. Even if you're the biggest IT company in India, it cannot foreclose your career graph. No one can stop you if you have gained knowledge, experience, and courage to go ahead. Bitter experiences always help, but only in the future. Why don't you think to blacklist that company in the minds of those potential candidates, so they will not be victims like you? Also, spread the word to the market not to approach this company for products and solutions.

Note that there are good customers in this world who look for solutions only from those companies which treat their country, people, and environment better, not focusing solely on cost, after-sale service, or price. You have options to make your name whitelisted and to fight directly against your company, which may involve huge costs and efforts on your part. This may impair your career as you will need to pay attention to these things, find more time to spare on this issue, and limit your mobility to join another company in a distant place.

Please know that this world is vast, and even if a company is the biggest corporate giant, it is nothing more than a mustard seed. It is the mindset of people in the organization and its management that makes it bigger, not just size and turnover. Never claim in writing to your company that you have done something; let them provide written feedback to you. Even if it is a notice indicating termination, nothing will impair your growth if you have the mindset to evolve.

First, let's put things straight. Indian companies threaten employees under the name of "blacklisting" them so that they cannot get a job in the future. However, if you leave a company with short notice, absconding, or insubordination, the employer CANNOT blacklist you from future employment.

If an employee discovers that a particular employer is hindering future employment opportunities, they can sue the employer for an ungodly sum of money in court and WIN!! The employer will have to face the consequences.

So, don't ever, ever consider blacklisting an employee. Things don't work that way; what you see as unfair will not be unfair to everybody. If an employee disappears or absconds from your organization, think about what you can do to decrease attrition rates instead of taking unlawful shortcuts. That is the correct approach.

Please don't get caught in a class-action lawsuit. It will be very detrimental to the company and your life since the chairman will first reprimand you - the HR - and the thousands of employees working under your supervision.

Blacklist within your own company. Don't attempt to create a blacklist that prevents an employee from joining other companies. If you choose the latter, you are acting unlawfully and will face severe consequences if the employee takes legal action against you.

May I know if a company can blacklist me on the grounds that I want to leave because I am not interested in continuing? I have never had any bad records in the past. In fact, I have developed medical problems after working in it. Instead of any compensation, they want to blacklist me. Please answer me quickly as I have to submit the full and final papers today.

Dude, nobody can blacklist you from employment other than the company which you are leaving. If you find out that they are blacklisting you in other companies as well, sue them for libel/defamation. Don't go idle, Indians are cowards, and the IT services companies in India are taking advantage of this. Don't be a coward and stand up for your rights to human employment by suing them using ninja attorneys.

Apart from that, if you are blacklisted for fake experience, and you have been faking your experience, then... ahem... Companies in India internally maintain a blacklist, which they share with other companies. You will have to accept that you will not be recruited by a significant number of companies in the future.
