How To Withdraw The PF Amount Without The Signature Of The Employer

We have two different companies (X & Y) under a single MD and Joint MD (Brothers). Due to personal problems, the companies have separated. Now, some of the X company employees have shifted to the Y company. Previously worked X company employees are not ready to transfer the PF amount and need to withdraw the same. When Y company approached the X company to sign the withdrawal forms, they refused.

Could you please guide me on how to withdraw the PF amount without the signature of the previous employer?

Some more clarification is required. Whether the two companies' board of directors are the same? In such a case, the power of the Authorized Signatory will not change. Until the authorized signatory is changed with the RPF Office, any one of the authorized signatories can sign on the withdrawal form. Instead of withdrawing, transferring the PF accumulation is better and advisable.

Why are you worrying? For a transfer, if your organization does not have a PF Trust or you are submitting contributions directly to the PF Office, you need to fill out Form No. 13 and submit it to the PF office through your present employer for transfer. It is the duty of the PF office to transfer the amount to your new PF Account. If you wish to withdraw, you do not need to go to your present employer. Please fill up Form No. 19 and refer to the instructions on the form, which mention the gazetted officer who can sign Form 19. After getting the signature, please submit it to the PF office. Please confirm that returns 12 and Form 3A have been submitted to the PF office for the last accounting year. You can also enclose a letter with Form 19 stating that your present employer has refused to sign the form. It will be the duty of the local PF commissioner to settle your case.
