Can I Join My Client After Resigning from TCS? Seeking Clarity on Contractual Restrictions

Hi,

Can a client of TCS recruit a TCS employee? I've resigned from TCS and am currently serving the notice period. I had some other offers at the time I resigned. I remember a clause from the overseas deputation agreement - that while on deputation, I cannot accept an offer from any client/competitor of TCS. Does this mean that one can accept offers when they are off from the deputation?

I'm asking this because I've recently been pursued by my client to join them. We were informed that there is a contract between TCS and its client for employee retention. However, the client manager seems to have no clue about such contracts, indicating that this is merely a myth spread within TCS.

I find this offer better than the others and thus, I really want to join this one. Could anyone please provide me with some idea of the possibilities I have? Also, if there is any clause, who is this for, and how is it valid?

Hi Guruvai,

If there is a written agreement between TCS and its client, it will likely include a clause stating that the client cannot hire TCS employees for a certain period of time after their resignation. Please verify this information before making any decisions.

It depends on the country and the client. I am in a similar situation, and our client has a non-compete clause of 6 months.
