Hi Gurus,

I want to know a few things regarding the accident in the office premises.

1) What if an employee is not under ESIC and met with an accident in the course of employment?
2) Is the company liable to pay his hospitalization expenses?
3) What if an employee is going for a visit and meets with an accident, and he is at fault?
4) Is it okay if we have Accidental and Medical Insurance for employees to avoid further liability?

Dear,

If an employee is not under ESIC, then the Workmen's Compensation Act will apply to him. Hospital bills to be paid by the company are not legally required, but ethically the company should pay. Yes, accidental and medical policies should be in place.

Is it a statutory compliance to cover the employees (excluded from ESI Act) under Workmen Compensation in the same factory? I mean, will it be valid to apply the WC Act and ESI Act both in a single factory?

Hi All,

I am working in an Apparel Retail Outlet as a Store Manager. I met with an accident in the Company Store. While a customer was trying on clothes, they accidentally closed the door of the trial room, and I injured my left hand. Specifically, my left ring finger's distal phalanx was snapped off. I went to the doctor, who stitched and reattached the distal phalanx, but it is not functioning properly now.

My company is willing to cover all medical treatment expenses. However, I am wondering if there is any law or act, like the Workmen Compensation Act of 1923, where I can seek compensation for this disability or loss of earning capacity?
