Struggling to Recover PF Dues After Employer Change – How Can I Get My Funds Back?

Respected Sir,

I am an outsourced employee of ICICI Bank. As per its outsource system, I had to change my employer, which is the bank's subsidiary organization. My PF account is newly opened with the new employer, and now I want to recover my PF dues from my previous employer. I was there for 1 year and 4 months with this employer, and in April 2018, the employer changed.

Repeatedly asked by me to the bank's concerned employee, there is no proper response, and they are not taking any steps to get back my PF fund. Please give me the solution for such an issue. I want my funds back.

If you wish to transfer the old PF balance to the new one, you can just send Form 13 duly filled in and signed by your present employer to the Employees' Provident Fund Organisation's office. This requires no attestation by the previous employer.

If you want to withdraw the balance (availing withdrawal benefit), you have to submit Form 19 and 10 C in which the previous employer's signature is required. Though there is a provision in the Act that a Bank Manager, Member of Parliament, Member of Legislative Assembly, Member of EPF Central Board of Trustees, and similar nominated persons can sign it as attested, the EPFO encourages the attestation by the employer himself. Therefore, in case the previous employer is not cooperating, it is better to transfer the account.

Dear [Employer's Name],

Please inform the present employer to fill out Form No.13 for the transfer of PF to your new PF account with the present employer. The employer will send Form No.13 to your present employer (if it is a Trust). If not, Form No. 13 will be directly sent to PF Authorities. You need not worry; it will be the responsibility of PF Authorities to get the amount transferred to your new PF Account.
