Can I Transfer My PF During Notice Period Before Moving Abroad? Seeking Advice

Hi, I resigned from my present job to join my husband abroad. I am presently serving my notice period. I didn't transfer PF from my previous employer when I joined my present company. Can I submit the transfer forms now during my notice period to my present employer? Can my present employer reject the forms, saying that they will not process the forms as I will no longer be an employee?

I don't want to withdraw my PF amount as I will start working in India when I return after 1.5 years. Please advise. Thanks in advance.

Form 13 need not be sent to and attested by the previous employer. It should be signed by the present employer, and only through him can it be submitted to the EPFO.

Just on the grounds that you are in the notice period, the employer cannot refuse to sign the transfer form. It is the duty of the employer to obtain either Form 2 when an employee joins or, alternatively, to get Form 13 if the new employee already had an EPF account with the previous employer. In your case, the employer should have taken Form 13 and sent it to the EPFO when you joined. Therefore, you can send Form 13 now and later, after 2 months, submit the other forms (Form 19 and Form 10C) required for the withdrawal of the Provident fund. You can obtain a scheme certificate by opting for the same in Form 10C so that when you return and join another establishment, your service will be counted. It is meaningless to keep both accounts (Provident Fund and Pension Fund) as non-contributory until you take another employment in India.
