Entitlement for Maternity Leave Any women employee who have completed minimum of 80 days of service with the organisation from which she is claiming the maternity benefit, is eligible to get Maternity Benefit under the Act.
Maternity Leave- 12 weeks paid leave in running days of which minimum 6 weeks should be post delivery.
- Further 4 weeks paid leave can be availed in case of complication in delivery. This can be in running days also. An employee needs to apply for this leave separately stating the reason of complication in delivery supported by medical documents.
- 4 weeks leave without pay can be availed for childcare. This can be in running days also. An employee needs to apply for this leave separately.
- In case of miscarriage, 6 weeks paid leave immediately after miscarriage can be availed, after submitting medical certificate.
Procedure to complete to avail the benefit under the act from ESIC- Employee needs to obtain form no 20 and 21 from local ESIC Hospital.
- Submit the copy of form no 20 and 21 to ESIC office Also, require to submit one copy of Form no 20 and 21 at Office to HR Department
- It is not necessary that delivery should take place at ESIC Hospital only. It is up on the choice of employee to consult any hospital for the said purpose.
- After delivery within thirty days, needs to obtain Form no. 23 from Local ESIC Hospital. To obtain from No. 23, it is compulsory to have Birth Certificate of newly born child.
- Submit the copy of Form No. 23 to ESIC office. submit one copy at Office to HR Department
Payment of Salary during Maternity Leave Payment of Maternity leave will be, made by ESIC after submitting the Form No. 20, 21 and Form No. 23.
