How Can I Claim My Gratuity and Leave Encashment After Leaving My Job?

arup74luv
I was working with an educational institute and was associated for more than 6.5 years. I have left the organization on 1st May 2008. I was released, and I am in the process of getting the PF. However, the company has not cleared my Gratuity, Leave Encashment, and some conveyance amount, which totals around Rs. 1.5 lacs. How should I approach and get the claim? Please help me in this regard. It was not mentioned in the company rule book that gratuity would be given to the employees. However, I have completed 6.5 years of service there. Please help me in this regard.

Arup,

Gratuity is a central act; it is applicable to all industries having 10 or more employees. If the employer is unwilling to clear your dues, please prepare a full and final statement at your end and send it via registered mail with acknowledgment due. Hopefully, this will resolve the issue.

Arup,

As per Arup guidelines, gratuity is applicable to all industries. After this, you can go to the Labor Office with your Appointment Letter. They will take care.

Certainly! Here is the revised text with the spelling, grammar, and formatting corrections:

Kindly provide me with the letter format on how to apply for a full and final settlement. Please send me the format as soon as possible. You have only addressed gratuity; what about leave encashment and conveyance bills that are still unpaid? Please respond promptly. I need assistance. Kindly send me a format (letter) detailing how to apply for gratuity, leave encashment, and conveyance so that I can submit the letter to my previous employer and also to the labor commissioner. Can my period of service be verified from the PF office, right?

I hope this helps! Let me know if you need further assistance.
